Terms of Service

1. Agreement to Terms

By accessing or using the BluTexts platform ("Service"), including the web application, API, desktop agent, and Chrome extension, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

BluTexts is a customer relationship management (CRM) integration platform that enables businesses to send, receive, and manage iMessage conversations through a web dashboard, Go High Level integration, and a dedicated macOS desktop agent. The Service acts as a bridge between Apple's iMessage system (running on your hardware) and your CRM workflow.

3. Eligibility

You must be at least 18 years old and have the legal authority to bind the business entity you represent. By using the Service, you represent that you meet these requirements.

4. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@blutexts.com if you suspect unauthorized access.

5. Fees & Billing

  • Setup Fee: A one-time $399 setup fee is charged at the time of checkout. This covers provisioning of your dedicated macOS device, phone number assignment, and initial configuration.
  • Subscription: After the setup fee, you will be billed $199/month or $2,600/year depending on the plan selected at checkout. Subscriptions automatically renew unless cancelled before the next billing cycle.
  • Payment: All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • Refunds: The setup fee is non-refundable once device provisioning has begun. Subscription fees for the current billing period are non-refundable upon cancellation; you retain access through the end of the paid period.

6. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk messages (spam) or violate anti-spam laws (CAN-SPAM, TCPA, etc.)
  • Harass, threaten, or abuse any person
  • Transmit malware, phishing links, or other harmful content
  • Impersonate any person or entity
  • Violate any applicable law, regulation, or third-party rights
  • Attempt to circumvent rate limits, access controls, or security measures
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

7. iMessage & Apple Disclaimer

BluTexts is not affiliated with, endorsed by, or sponsored by Apple Inc. iMessage is a trademark of Apple Inc. The Service operates on hardware you own or lease that runs macOS and the Messages application. You are responsible for complying with Apple's terms of service for macOS and iMessage. We do not modify or circumvent Apple's software; the desktop agent reads from and writes to the iMessage database using standard macOS APIs and AppleScript.

8. Third-Party Integrations

The Service integrates with third-party platforms including Go High Level (GHL) and Stripe. Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability, accuracy, or functionality of third-party services.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by BluTexts and protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you transmit through the Service (messages, images, etc.).

11. Service Availability & SLA

We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUTEXTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless BluTexts from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

You may cancel your subscription at any time through the billing portal. We may suspend or terminate your account for violation of these Terms or for non-payment. Upon termination, your access to the Service will cease and your data will be handled in accordance with our Privacy Policy.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Florida.
